THE HORSE TROUGH TERMS AND CONDITIONS

1.   General

These Terms and Conditions govern your use of The Horse Trough website (Horsetrough.co.uk) and your relationship with “Horsetrough.co.uk” (The Horse Trough, often referred to WE or US in the body of these Terms and Conditions).  You will find all information relating to the use of the site and its services.  Please read them carefully as they affect your rights and liabilities under the law.  If you do not agree to these Terms and Conditions, please do not use the Horsetrough.co.uk site or its services.  Please note that, to use any of the services offered, you will need to register by creating an account.

We may change or update these Terms and Conditions at any time.  Where possible, we will declare such changes if they are material.  The changes will apply to the use of the Horsetrough.co.uk site on the date they are posted on our website.  If you do not wish to accept the new Terms and Conditions you should not continue to use the Horsetrough.co.uk site.  If you continue to use the Horsetrough.co.uk site after the date on which the change comes into effect, your use of the Horsetrough.co.uk site indicates your agreement to be bound by the new Terms and Conditions.

These Terms and Conditions are governed by English Law and are subject to the nonexclusive jurisdiction of the English courts.  We do not accept amendments to these Terms and Conditions other than those made by us.  Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions at any other time.

Whenever you use any of the services of the Horsetrough.co.uk site, you will be asked to read and accept the Terms and Conditions prior to use of that service.  We strongly advise that you do take the time to read the Terms and Conditions for the avoidance of any doubt or misunderstanding.

2.   Website

a.   Ownership.

This site is owned and operated by The Horse Trough, Dishley Grange Farm, Derby Road, Loughborough, Leicestershire, LE11 5SF, VAT Registration Number 917 2171 36.  If you want to ask us anything about these Terms and Conditions or have any comments or complaints on or about our website, please contact us.

If you are not satisfied with the site, then please contact us.  However, ultimately your only legal recourse is to stop using the site.

b.   Rights.

All rights, including copyright, in this website are owned by or licensed to the Horsetrough.co.uk.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of The Horse Trough.  You may not modify, distribute or re-post something on this website for any purpose.

The Horsetrough.co.uk works to keep the site up to date but cannot guarantee that this site and its contents are completely free of technical errors.  By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site.  We are also not liable for any damages associated with use of this site however caused.

c.   Accuracy of content.

The Horsetrough.co.uk has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described.  However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website.  All prices are displayed inclusive of VAT.  Packaging may vary from that shown.  The weights, dimensions and capacities given are approximate only.  We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, the Horsetrough.co.uk disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website.  The Horsetrough.co.uk shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

The views expressed in any user generated content are the opinions of those users and are not necessarily those of the Horsetrough.co.uk.

Before you place an order you should read the following sections detailed below: Paragraphs 6 “Ordering”, 7 “Cancellation, amendment, exchange and returns/refunds” and 9 “Delivery”.  These pages form part of these terms and conditions and contain important information about your order.

d.   Use of the website.

Please note, any use of this website or purchase made through this website constitutes an agreement to abide by the Terms and Conditions detailed below, which shall override any other Terms and Conditions.  Further, whenever you use any of the services of the Horsetrough.co.uk site, you will be asked to read and accept the Terms and Conditions at some stage during your use of that service.  Any contracts or agreements formed between you and us by means of this website shall be governed and construed according to English law and any disputes or proceedings shall be subject to the exclusive jurisdiction of the English courts.

The Horsetrough.co.uk site is provided to you free of charge for your personal use subject to these Terms and Conditions.  By using the Horsetrough.co.uk site you agree to be bound by these Terms and Conditions.

The Horsetrough.co.uk site is made up of a number of information and service pages.  These Terms and Conditions govern your use of the Horsetrough.co.uk site and the online pages and all services provided in connection with these.

The services provided by The Horse Trough website do not include the provision of computer or other necessary equipment to access the website.  To use the www.horsetrough.co.uk site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.

e.   Registering/Creating an Account.


To register/create an account with the Horsetrough.co.uk, you must be over eighteen years of age.

You must ensure that the details provided by you on registration or at any time are correct and complete.

You must inform us immediately of any changes to the information that you provided when first registering/creating an account by updating your personal details.

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

You can cancel this agreement at any time by informing us in writing.  E-mail communication is accepted as being in writing.  If you do so, you must stop using the Horsetrough.co.uk site.

The suspension or cancellation of your registration/account and your right to use the Horsetrough.co.uk site shall not affect either party’s rights or liabilities.

Paragraphs 2.f. “Limitations”, 3.b. “Intellectual Property” and 3.d. “Liability” of these Terms and Conditions shall survive cancellation.

f.   Limitations.

The Horsetrough.co.uk site itself is provided by the Horsetrough.co.uk without any warranties or guarantees.  You must bear the risks associated with the use of the Internet.

The Horsetrough.co.uk site will, on occasion, provide content from other Internet sites or resources and while the Horsetrough.co.uk tries to ensure that material included on the Horsetrough.co.uk site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case.  The Horsetrough.co.uk will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Horsetrough.co.uk site.  If the Horsetrough.co.uk site is informed of any inaccuracies in the material on the site we will attempt to correct the inaccuracies as soon as we reasonably can. 

You may not use this website for any of the following purposes:

  • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
  • Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

  • Any claim by any third party that the use of the Horse Trough website by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
  • Any claim by any third party that the use of the Horse Trough website by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and
  • Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Horse Trough website by you.

g.   Website – international use.

Unless otherwise specified, the materials on this website are displayed solely for the purposes of promoting The Horse Trough’s products and services available in the United Kingdom and The Horse Trough makes no representation that any products or services referred to in the materials on this website are appropriate for use in or available for delivery to other locations outside of the UK.  Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.

h.   Damage to computer systems.

The Horse Trough makes every effort to ensure that this website is free from viruses or defects.  However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer.  It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it.  The Horse Trough shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

i.   Third party websites / links to other websites.

As a convenience to our customers, The Horse Trough website may from time to time have links to other websites that we think you may want to visit, though these sites will not be maintained by us.  We do not vet these websites and do not have any control over their contents.  The Horse Trough cannot accept any liability in respect of the use of these websites.

j.    Advertising and sponsorship.

Part of The Horse Trough’s website may from time to time contain advertising and sponsorship.  Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on The Horse Trough’s website complies with relevant laws and codes.  We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

3.   Legal

a.   Law, jurisdiction and language.

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law.  The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.  All contracts are concluded in English.
 
These terms and conditions do not affect your legal rights.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.  We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.

b.   Intellectual property.

The content of the Horsetrough.co.uk site is protected by copyright, trade marks, database and other intellectual property rights owned, controlled or licenced to The Horse Trough.  You may retrieve and display the content of the Horsetrough.co.uk site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.  No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying.  You may not otherwise reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, exploit in any way or use for commercial purposes, in whole or in part, any of the material, contents of  the site, or any related software without written permission from The Horse Trough  .  In the event of any of the above unauthorised actions, The Horse Trough will be entitled to take legal proceedings against the persons concerned.

No licence is granted to you in these Terms and Conditions to use any trade mark of The Horse Trough or the Horsetrough.co.uk.

c.   Changes to terms and conditions.

We reserve the right to change these Terms and Conditions from time to time and you should look through them as often as possible.

d.   Liability.

We disclaim all liabilities in connection with the following:
  • Incompatibility of the Horsetrough.co.uk site with any of your equipment, software or telecommunications links.
  • Technical problems including errors or interruptions of the Horsetrough.co.uk site.
  • Unsuitability, unreliability or inaccuracy of the Horsetrough.co.uk site.
  • Inadequacy of the Horsetrough.co.uk site to meet your requirements.

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Horsetrough.co.uk site.

Nothing in relation to disclaimers and exclusions of liability in these Terms and Conditions shall exclude the Horsetrough.co.uk’s liability in respect of products sold through the website.

Nothing in these Terms and Conditions shall exclude the Horsetrough.co.uk’s liability for personal injury or death caused by its negligence.

All disclaimers and exclusions of liability shall be governed by and construed in accordance with English Law.  If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

We are not liable for any loss caused to you by late delivery.  There are only so many things we can influence.  The Delivery section of our Terms and Conditions on the website gives you a guide to when your goods will be delivered.  As part of the shipping process, an e-mail is sent to you when your goods are dispatched.

We will not be responsible for any losses resulting from your use or the inability to use our website.  If this results in unauthorized access to, or alteration of your transmissions or data in circumstances, we will not be held liable.

We will not be responsible for any loss of your profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

e.   Data Protection Act.

Your privacy as an individual and as a customer is important to us, so we do not use the information you provide on this site to learn any more about you other than what is required to fulfil your orders or offer you services such as new alerts or reminder services.

The Horse Trough does not combine your individual information with any kind of site analysis, but we will, from time to time, engage in reviewing the overall browsing behaviour of our customers to improve the way the site navigates.  We also do not track your behaviour on any other sites or follow you once you have left the Horsetrough.co.uk site.

Any personal data gathered by us in your use of this site may be recorded.  Under the terms of the Data Protection Act 1998, we have a duty to protect any information we collect from you.  It will not be disclosed to any other organisation unless you give explicit permission, or there is a legal obligation to do so.  We collect information about you for three main reasons:

  • To process your online order.
  • To provide you with the most efficient possible service.
  • To compile accounting and associated records.

The information collected will be used to personally keep in touch with you.  We will use your e-mail address as a convenient way of contacting you about any order you have made and to let you know of any relevant website news, offers, sales or promotions that the Horsetrough.co.uk are carrying out.  We will only do this with your permission.

We will not pass your details on to any other relevant third parties that we think you may be interested in if you have requested us not to do this.

You have a right to request a copy of any personal data held by the Horsetrough.co.uk at any time.  If you wish to do this, please write (explaining that your interest is in personal data maintained by The Horse Trough) to:

f.   Other legal matters.

There may be legal notices on other areas of this website which relate to your use of this website, all of which will, together with these Terms and Conditions, govern your use of this website.

If any provision of these Terms and Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of any remaining provisions.

This site and its contents will not constitute the basis for any contractual commitment between the Horsetrough.co.uk and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of products by the Horsetrough.co.uk would contravene any applicable local, regional or national legislation.  No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for the Horsetrough.co.uk to sell products.

4.   Products

a.   Product availability.

Products are subject to availability.  We always seek to ensure that stock is available and that our products page is up to date to reflect availability.  Our product pages will identify whether an item is in stock or not.  There may be occasion where, due to unforeseen circumstances beyond our control, a particular product advertised may no longer become available.  Should this happen after you have made an order, we will contact you to advise you and offer you an alternative or the opportunity to cancel your order.

You will not be able to order an item that is currently listed as out of stock.  If you do wish to pursue an order for an item that is currently marked as out of stock, then please contact us by e-mail.  We will endeavour to fulfil any such requirements as soon as stock is replenished.  However, whilst we always endeavour to ensure that our prices remain competitive by being the same, as new stock is delivered, prices may change though we will try to keep this to a minimum.  We will always advise you should this happen so that you may review your requirements.

We shall not be liable for any losses, costs, damages, charges, or expenses caused by the non availability of any product.

b.   Product guarantees.

All our products offer the normal guarantees.

All product guarantees are related to the product only and not any associated postage/delivery costs or any gift wrapping costs if this service is used.

5.   Pricing

a.   General

At The Horsetrough, we aim to keep our pricing policy as simple as possible as we want you to be confident that you have not only chosen the right product for you but that you have chosen it at the most competitive price.  All prices as shown on our website are inclusive of VAT but exclusive of delivery charges, which will be payable as indicated at the time the order is placed.

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged.  Whilst we always seek to avoid changes, it may be necessary to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission, the price published for the goods is wrong whether or not the order has been acknowledged.  We will always inform you if this happens so that you may confirm that you wish to proceed with or cancel your order.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in our store.  We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website.  Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.

From time to time the prices displayed on our website may be different if you are directed to it from a third party website.  Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website.  These prices will not be available in-store or over the telephone.

Prices that are reduced for sales and promotions on the website are only valid for the specified period as detailed at the time.

Should there be an error in the description or price of goods in the catalogue, The Horse Trough reserves the right to supply goods at the correct price.

b.   Discounts

Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.

Where purchases are stated to be offered on a "VAT-free" basis, the prices of qualifying items will be reduced by the equivalent of VAT.  As a guide, at the VAT rate of 17.5% this equates to a discount of 14.9%.  Please note that the VAT rate can change from time to time.  We will reduce the price to the equivalent of the applicable VAT rate in force at the time.

Supplementary charges such as delivery or postage and packing shall not be discounted unless specifically stated in the offer description.

6.   Ordering

a.   General.

To order goods on our website or over the telephone, you must be at least 18 years of age and must be able to accept delivery within the UK. 

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks.  This helps to protect you and us against fraudulent transactions.

b.   Online ordering.

Your order is sent directly to our secure till in our shop for processing.  Once we have received your order and payment, we will pick, pack and dispatch the item.  We will aim to do this the same day for all orders in to our shop Monday-Friday (excluding Bank Holidays).

Once you have completed an online purchase, we will send you an e-mail confirming the order details.  Please note that electronic acknowledgements do not constitute order confirmation or order acceptance.  Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been despatched or collected.  We will take payment for your order immediately and goods will not be dispatched until receipt of payment.  Whilst we are under no obligation to accept your order, we would normally do so where (i) the product is available, (ii) the order reflects current pricing and (iii) your credit card/debit card payment is approved by your credit card/debit card company.  Alternatively, we may decline all or part of your order for any reason, in which case we will contact you to inform you in person or by telephone or e-mail.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you come into the store.  If you decide not to pay by an alternative method, we will cancel your order.

c.  Telephone ordering.

Orders can also be placed via our customer service line on 01509 842626 during the following times:

Monday/Thursday/Friday:      Between 10 a.m. – 6 p.m.
Tuesday/Wednesday:            Between 10 a.m. – 5 p.m.
Saturday:                                  Between 10 a.m. – 4 p.m.
Sunday:                                    Closed.

Please note that the store will be closed on all Bank Holidays unless specifically stipulated by special notice on the website.

All telephone orders will be acknowledged verbally at the time of order and will then follow the process as for online ordering.

d.  Order acknowledgement.

Once you have placed an order we will send you an e-mail to acknowledge that we have received your order (if you have supplied us with an e-mail address).  The email confirmation will include confirmation of your order details.  The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order.  In some instances, it may be necessary to telephone you to acknowledge your order.

Please note that e-mail or telephone acknowledgements do not constitute order confirmation or order acceptance (see section 5.e. “Order Acceptance” below). 

e.   Order acceptance.

Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected.  (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person or by e-mail or telephone).

f.   Order errors.

You are able to correct errors on your order up to the point at which you click on ‘place order’ on the final page of our ordering process.  After this point, order errors cannot be changed and you will need to follow the procedure for order amendment as detailed in section 7. “Cancellation, amendment, exchange and returns/refunds” below.

g.   Order Tracking

You can track the progress of your order at any time by logging into My Account from the Home page on this website.

h.   Order restrictions.

Where the order concerns knives or bladed articles, you are confirming that you are over 18 when you place an order.

7.   Cancellation, amendment, exchange and returns/refunds.

a.   General

We always aim to provide you with every satisfaction when you shop online with The Horse Trough.  If, however, for any reason, you are not satisfied with your online purchase, we will do our very best to meet your needs.  Please note that, for cancellations, exchange and returns/refunds, you have 7 working days to return your order.  Do not hesitate to contact us at customerservices@horsetrough.co.uk or by calling us in store on 01509 842626 where we will be happy to discuss the options available to you, otherwise, please refer to the cancellation, amendment, exchange and returns/refunds sub sections below.  In all cases, you will need to provide us with appropriate contact details and purchase information such as the date of purchase, the item description and the name of the person who purchased the item. 

If the goods delivered have been damaged in transit, please contact us immediately and return the product to us.  We will replace the item free of charge and take your case up with the courier.

Returned goods are to be at your own expense until The Horse Trough physically receives the returned goods.  The Horse Trough regrets that it cannot accept responsibility for goods returned by you that are subsequently lost in the post during their return journey.  Accordingly, for your own benefit, when returning goods direct to The Horse Trough, we strongly advise that you use Royal Mail Special Delivery.  This system provides proof of delivery and insurance on the goods whilst in transit.  We are sorry but postage and packing cannot be refunded on returned items.

Unfortunately, due to Health & Safety Laws, any earring jewellery that has been purchased has to be returned in sealed packaging unless the goods that are being returned are faulty.  We cannot accept return of such goods where it is clear that the sealed packaging has been opened and/or the earrings have been worn.  This does not in any way affect your statutory rights.

If you need to return an item please note that it needs to be returned in its original and unused condition including original label tags and accompanied by the gift box and certificate (if appropriate) and your receipt. You will need to quote any return reference number that customer services may provide you.

If you are outside the 7 working day time limit, at the sole discretion of and by prior arrangement with The Horse Trough and subject to goods being returned in mint condition, you may be offered a credit note for the value of the goods, which can be redeemed at any time in store or online over the following three months.  This is limited to 28 days after the goods have been purchased online.

b.   Cancellation

Cancellation of an order refers to the situation when goods ordered by you have physically been received by you and you wish to cancel that order.

Under the distance selling regulations you have the legal right to cancel your order within 7 working days of receipt of the goods.  Where goods are delivered to a third party (e.g. through our Gift service) you will only be able to exercise this right if you are able to return to us the goods you ordered.

After goods have been received by you, the packaging may be opened but the goods must not be used.  Items returned under cancellation should be in a re-saleable condition.  Returns or collection arrangements are to be made promptly and at your own cost.  If the collection of an item has to be arranged by us, we will charge you the cost of collection (up to £100) of which you will be notified at the time of cancellation.

All goods for cancellation that are returned for cancellation must be accompanied by all paperwork supplied with the order and any gift boxing (if applicable).  Please note that, where goods are claimed as faulty, we will not allow cancellation of an order where it is clear that the goods have been damaged through accident, neglect or misuse after delivery.  This does not affect your statutory rights.

If we have made an error and sent you an item that you did not order and you wish to cancel, we will refund you the cost of postage that you incur on return of the item.

c.   Amendment

Amendment of an order or part of an order refers to the situation when an order has been formally placed by you on the website’s ordering system and you want to amend that order before the goods are despatched. 

As soon as you realise that you need to amend your order please contact us on 01509 842626 and we will do our best to help you.  If you do amend your order, you may find there are changes to your delivery timescale and/or the price you pay for the item (as you will be charged the current selling price on the day you amend the order). 

We cannot amend your order once it has been despatched.  You will need to follow the process for cancelling an order, exchanging an order or returning/refunding an order as appropriate.

d.   Exchange

Exchange of an order or part of an order refers to the situation where you have received goods and you are dissatisfied with some or all of the goods either because the good(s) are faulty, are not the required size or specification ordered or are not what you expected.

Items for exchange must be returned within 7 working days of receipt of the goods.  Where goods are delivered to a third party (e.g. through our Gift service) you will only be able to exercise this right if you are able to return to us the goods you ordered.

After goods have been received by you, the packaging may be opened but the goods must not be used.  Items returned under exchange should be in a re-saleable condition.  Returns or collection arrangements are to be made promptly and at your own cost.  If the collection of an item has to be arranged by us, we will charge you the cost of collection (up to £100) of which you will be notified at the time of cancellation.

All goods for exchange that are returned for exchange must be accompanied by all paperwork supplied with the order and any gift boxing (if applicable).  Please note that, where goods are claimed as faulty, we will not allow exchange of an item where it is clear that the goods have been damaged through accident, neglect or misuse after delivery.  This does not affect your statutory rights.

When returning your goods for exchange, please advise whether you require a different size.  We will endeavour to send out your exchanged item immediately however, the new item required may not be in stock.  Please allow at least 7 working days for exchanged items to be despatched.

Where an exchange is requested and the new item is a different price, we will either charge or refund your credit/debit card.  We will always contact you either by phone or e-mail before doing this.

If we have made an error and sent you an item that you did not order, we will correct this through exchange and  will refund you the cost of postage that you incur on return of the item.

f.   Substitution

We are confident that we can meet your order requirements.  However, there may be isolated occasions where, due to circumstances beyond our control, we cannot supply all or part of your order.  In such circumstances, we will try and find another product that matches your requirements.  Where this occurs, we will contact you first before despatching the goods to seek your acceptance of this substitution.  We will reimburse you for the cost of returning substitute item(s) that you do not wish to physically accept but this is subject to the item(s) being returned within the 7 working day period and being in an unused, re-saleable condition.

8.   Payment

a.   General

All methods of payment, including credit cards are processed once your order is prepared for despatch.

You can pay for your order using Visa, MasterCard, Visa Delta, Electron, Maestro, Solo and JCB. Please note that we do not accept American Express.

Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.

We use the industry leading internet payment company PayPal to protect your card details and protect from fraud.  Please see section 8.c. “Security (PayPal)" below.

The Horse Trough must receive payment in full for your order before it can be accepted.  Once your payment has been authorised and cleared, we will send you an e-mail confirmation.  Please keep this e-mail confirmation for your records. 

b.   Cheques

We regret that, due to the modernisation of electronic payment methods now available to the general public, we are no longer able to accept cheques as payment for goods purchased through The Horse Trough website.  We hope that you do not find this too disappointing.

c.   Security (PayPal)

We use the industry leading internet payment company PayPal to protect your card details and protect from fraud.  PayPal are more secure than direct online payment with credit cards with an industry-leading loss rate is less than 0.5%.  With PayPal, you also have extensive protection against fraudulent transactions from your account.  For example:

d.   Fraud

To protect you, our valued customers, from the issue of credit and debit card fraud, we reserve the right to cancel any order where the customer uses a credit or debit card issued by a card provider based in a country other than the customers delivery address.  In such cases, we will attempt to contact the customer for additional information.  If, within 5 working days, the customer fails to provide the information we require to verify their identity and address, or if it is clear that there have been fraudulent entries in the account registration process, then the order will be cancelled by us.

9.   Delivery

a.   General

We understand how important it is to you that your goods are delivered in good time and in good condition.  That is why we use our courier partner Eclipse Limited. 

Please note that normal delivery will be pre-selected unless you choose to opt for next day guaranteed delivery.

b.   Normal Delivery

The price for normal delivery is £7.50.  This price is regardless of weight.  Orders made before 2 p.m. Monday to Friday (excluding Bank Holidays) will usually be despatched the same day subject to payment being accepted.  Orders after 2 p.m. will be despatched the following working day.  For all mainland UK orders using normal delivery, actual delivery will be within 5 working days.

c.   Next Day Guaranteed Delivery

Next day guaranteed delivery means delivery on the next working day after order acceptance.  The price of next day guaranteed delivery is £9.50.  Price of delivery is regardless of weight.  Orders must be received with payment accepted before 2 p.m.

d.   Free Delivery

For all order over £150, the price of normal delivery is free.

12.   Security

a.   General

We use Internet standard encryption technology to scramble your sensitive data when you transmit it to us. This process is known as SSL (secure sockets layer) and we are constantly updating our technology to provide you with the maximum practicable level of security.  To check that you are in a secure area of our site look at the bottom right of your browser and you will see a closed padlock or an unbroken key.

When you place an order, for your convenience we offer to retain your card details. These are maintained in a secure format. However, if you prefer that we do not maintain these details, you can go to ’My Account’, click on ’Your Card Details’ and delete any card information.

b.   Safety and Security Tips

  • If using a public computer or terminal, always log out and close the browser when you complete an online session.
  • Keep your passwords private. Remember, anybody who knows your password may access your account.
  • When creating a password, use at least 8 characters - a combination of letters and numbers is best. Do not use dictionary words, your name, email address, or other personal information that can be easily obtained. It is also recommended that you frequently change your password. c.   Account and Credit/Debit Card Information

We will never ask you to confirm any account or credit/debit card details via email.  If you receive an email claiming to be from The Horse Trough asking you to do so then please ignore it and do not respond.  You should contact us separately (see section 15. “Contact” below).

d.   Account / Password.

When you register to use the Horse Trough website you will be asked to create a password.  You must keep this password confidential and must not disclose it or share it with anyone.  You will be responsible for all activities and orders that occur or are submitted under your password.  If you know or suspect that someone else knows your password you should notify us immediately (see section 15. “Contact” below).

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account.  The Horse Trough shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

e.   Breach of Security

If The Horse Trough has reason to believe that there has been or is likely to be a breach of security or misuse of the Horse Trough website, we may require you to change your password or we may suspend your account.  We will notify you as soon as this is deemed a necessary requirement.

14.   Miscellaneous

The failure of The Horse Trough to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceablility.  The Horse Trough reserves its rights in respect of these terms and conditions at all times.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

The Horse Trough shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
